Payment Terms

• Payment of the non-refundable Booking Fee (equal to 30% of the Agreed Price) is required to secure the display booking and Event Date.
• The balance of the Agreed Price is required no later than one week prior to the Event Date.
• Full payment is to be received by the due date specified on the invoice. In the event that payment is not received within the agreed timeframe, the Client accepts full responsibility for any additional costs incurred in the recovery of the debt. This may include, but is not limited to, fees charged by a debt collection agency, legal expenses, and administrative charges. These costs will be added to the outstanding balance and are payable by the Client in full.

Cancellations

• Cancellations at the Client’s request must be made in writing a minimum of four weeks (28 days) prior to the Event Date.
• Cancellations within four weeks (28 days) of the Event Date will forfeit the Booking Fee.
• Cancellations within seven days of the Event Date will forfeit the full Agreed Price.
• Where a Display is cancelled and rescheduled within 6 months of the original Event Date, monies paid will be held in credit. Please note that an additional Booking Fee equal to 30% of the Agreed Price is payable to reschedule the display. This is due to the costs associated with seeking new permits and approvals.
• In the event of forecasted poor weather, the Client must liaise with Aura Fireworks prior the display to determine if the display is to proceed. Where a display is cancelled due to unsafe weather conditions, the Booking Fee is non-refundable. Additional labour charges may be payable where Aura Fireworks personnel have already departed for the venue. Note that Aura Fireworks can fire a display in light to moderate rain and wind provided there is sufficient distance to account for product drift.
• In the unlikely event of a total fire ban where the local fire authority does not allow the display to proceed, the Booking Fee is non-refundable.
• Aura Fireworks may subcontract third-party services to provide the agreed fireworks display (barge hire, security, etc.). In the event of cancellation of the display, the Client agrees to pay all costs for these services within seven days of cancellation.

Insurance

• Aura Fireworks holds $20M Public and Product Liability Insurance. Any requests for specific insurance indemnifications must be made a minimum of 14 days prior to the display.

Display Safety

• Aura Fireworks will determine where it is safe for the public to view the fireworks display.
• Aura Fireworks reserves the right to cancel a fireworks display prior to, or during, the display where we feel that firing of the display poses an unacceptable level of risk of harm to persons or property without incurring penalties in payment from the Client. This includes, but is not limited to, intrusion of the fireworks exclusion zone by unauthorised persons, product malfunctions and/or inclement weather. Aura Fireworks will make every effort to continue the display where it is deemed safe to do so.
• Aura Fireworks reserves the right to substitute or omit any pyrotechnic effect from a display which we feel may pose an unacceptable level of risk of harm to persons or property.

Event Organiser’s Responsibilities

• Aura Fireworks will provide barrier tape and bollards/star pickets to delineate the exclusion zone. Crowd control, security and/or safety fencing for the display (before, during and after) is the responsibility of the Event Organiser.
• The Event Organiser is responsible for ensuring the security of Aura Fireworks equipment against interference or theft from the time that Aura Fireworks arrives at, and departs from, site.
• For outdoor fireworks displays, the Event Organiser is responsible for notifying neighbours surrounding the firing site at least seven days prior to the display. Notification is to be in writing and must include the date, time and location of the fireworks display. Aura Fireworks can provide this service for an additional fee if required.
• The Event Organiser is responsible for obtaining permission for the display from the land owner or venue on/in which the display is being conducted. By completing the Online Booking Form, the Client confirms they have obtained landowner consent for the display.

Event Imagery & Marketing

• Aura Fireworks reserves the right to use any photos or videos of the event/display for promotional and marketing purposes unless otherwise agreed in writing.
